1. Acceptance of Terms
By accessing or using the Uptyke Education platform ("Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. If you are using the Platform on behalf of a school or organization, you represent that you have the authority to bind that entity to these terms.
2. Description of Service
Uptyke is an inclusive digital learning platform that provides CBC-aligned educational content designed for learners with disabilities in Kenya, including those with autism, deafness, hearing impairments, and visual impairments. Our services include video lessons, interactive activities, progress tracking, and learning management tools for parents, teachers, and schools.
3. Account Registration
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the confidentiality of your login credentials
- You must be at least 18 years old to create an account, or have parental/guardian consent
- Parent and teacher accounts may create and manage learner profiles on behalf of minors
- School accounts must be registered by an authorized representative of the institution
- You agree to notify us immediately of any unauthorized use of your account
4. Subscription and Payments
- Access to courses requires an active subscription plan
- We offer daily (KES 50), monthly (KES 199), and yearly (KES 2,500) plans
- Payments are processed securely through M-Pesa and PayPal
- Subscriptions may auto-renew unless cancelled before the renewal date
- Refunds are handled on a case-by-case basis; contact us within 7 days of payment for refund requests
- We reserve the right to change pricing with reasonable notice
5. Acceptable Use
You agree not to:
- Share your account credentials with others or allow unauthorized access
- Copy, distribute, or reproduce any course content without permission
- Use the Platform for any unlawful or harmful purpose
- Attempt to disrupt, hack, or interfere with the Platform's operation
- Upload malicious content or engage in harassment of other users
- Use automated tools to scrape or download content from the Platform
6. Intellectual Property
All content on the Platform — including courses, videos, illustrations, text, logos, and software — is the property of Uptyke Education or its content partners and is protected by copyright and intellectual property laws. Your subscription grants you a limited, non-transferable license to access content for personal, educational use only.
7. User Content
If you submit any content to the Platform (such as feedback or profile information), you grant Uptyke a non-exclusive, worldwide, royalty-free license to use that content in connection with the Platform. You represent that you have the right to share any content you submit.
8. Donations and Sponsorships
Donations made through the "Support a School" feature are voluntary contributions to help provide learning access to schools that cannot afford subscriptions. Donations are processed through PayPal and are non-refundable. Uptyke will use donations solely for the purpose of funding educational access for learners with disabilities.
9. Disclaimer of Warranties
The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or free from viruses. While we strive to provide accurate and up-to-date educational content, we do not warrant that the content meets specific educational standards beyond our stated alignment with the Kenyan CBC curriculum.
10. Limitation of Liability
To the maximum extent permitted by law, Uptyke shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.
11. Account Termination
We may suspend or terminate your account if you violate these Terms of Service. You may also delete your account at any time by contacting us. Upon termination, your access to courses and content will cease, and we may delete your data in accordance with our Privacy Policy.
12. Changes to Terms
We reserve the right to modify these Terms of Service at any time. We will notify users of material changes via email or a notice on the Platform. Continued use of the Platform after changes constitutes acceptance of the updated terms.
13. Governing Law
These Terms of Service are governed by the laws of the Republic of Kenya. Any disputes arising from these terms shall be resolved through the courts of Kenya.
